End User License Agreement & Terms and Conditions
Selam Ride Technologies Limited ("Selam Ride" or "the Company") is a company incorporated under the laws of the Republic of Uganda. The Selam Ride mobile application ("the Application") is licensed to You (the End-User) by Selam Ride Technologies Limited, located at Bunga, Makindye Division East, Bunga, Kampala, Uganda ("Licensor"), for use only under the terms of this End User License Agreement ("EULA").
By downloading the Application from the Apple App Store and/or Google Play Store, You agree to be bound by all of the terms and conditions of this Agreement. Apple Inc. and/or Google LLC are not parties to this Agreement and are not responsible for the Application. Selam Ride Technologies Limited, not Apple or Google, is solely responsible for the licensed Application and its content.
1. The Application
Selam Ride is a rideshare platform — a piece of software customised for Apple and Android mobile devices — used to connect Riders to Drivers for the purpose of transportation from one location to another within Uganda, operated via a simple, user-friendly interface.
The Application is designed to operate within the legal framework of the Republic of Uganda, including but not limited to the Traffic and Road Safety Act (Cap. 361), the Electronic Transactions Act, 2011, the Data Protection and Privacy Act, 2019, and applicable regulations issued by the Uganda Communications Commission (UCC) and the National Information Technology Authority – Uganda (NITA-U).
2. Scope of Licence
2.1 You are given a non-transferable, non-exclusive, non-sublicensable licence to install and use the licensed Application on any Apple-branded or Android device that You own or control, as permitted by the usage rules set forth in this Agreement and the applicable App Store or Google Play Terms of Service.
2.2 This licence governs any updates to the Application provided by the Licensor that replace, repair, and/or supplement the original Application, unless a separate licence is provided for such update.
2.3 You may not share or make the Application available to third parties, sell, rent, lend, lease, or otherwise redistribute the Application without Selam Ride Technologies Limited's prior written consent.
2.4 You may not reverse engineer, translate, disassemble, decompile, modify, or attempt to derive the source code of the Application without Selam Ride Technologies Limited's prior written consent.
2.5 You may not copy or alter the Application or portions thereof, except for backup purposes on devices You own or control. You may not remove any intellectual property notices.
2.6 Violations of these obligations may be subject to prosecution and damages under the laws of Uganda, including the Computer Misuse Act, 2011 and the Electronic Transactions Act, 2011.
2.7 Licensor reserves the right to modify the terms and conditions of this licence at any time, with reasonable notice provided through the Application or by email.
3. Technical Requirements
3.1 Licensor will endeavour to keep the Application updated so that it complies with new versions of device firmware and new hardware. You are not granted rights to claim any specific update.
3.2 You acknowledge that it is Your responsibility to confirm that the end-user device satisfies the technical specifications required by the Application, including compatibility with current mobile operating systems (iOS or Android) and a stable internet connection through Ugandan telecommunications providers such as MTN Uganda or Airtel Uganda.
3.3 Licensor reserves the right to modify the technical specifications as it sees fit at any time.
4. Maintenance and Support
4.1 Selam Ride Technologies Limited is solely responsible for providing any maintenance and support services for this licensed Application.
4.2 Apple Inc. and/or Google LLC have no obligation whatsoever to furnish any maintenance and support services with respect to the licensed Application.
5. Use of Data
You acknowledge that the Licensor will be able to access and adjust Your downloaded licensed Application content and Your personal information, and that the Licensor's use of such information is subject to Your legal agreements with the Licensor and the Licensor's Privacy Policy.
The collection, use, storage, and sharing of your personal data is governed by the Data Protection and Privacy Act, 2019 (Uganda) and the Selam Ride Technologies Limited Privacy Policy. Data may be processed using payment systems including MTN Mobile Money, Airtel Money, and other approved Ugandan payment service providers regulated by the Bank of Uganda under the National Payment Systems Act, 2020.
6. User Generated Contributions
The Application may invite you to contribute content including text, video, audio, photographs, graphics, comments, and suggestions. Any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create Contributions, you represent and warrant that:
- Your Contributions do not infringe any intellectual property rights protected under the Copyright and Neighbouring Rights Act (Cap. 215) of Uganda
- You are the creator or have necessary licences and permissions to use and authorise use of your Contributions
- Your Contributions are not false, inaccurate, or misleading
- Your Contributions are not obscene, harassing, libellous, or otherwise objectionable under the Computer Misuse Act, 2011 (Uganda)
- Your Contributions do not violate applicable Ugandan law, including the Penal Code Act (Cap. 120)
- Your Contributions do not contain material that solicits personal information from minors or exploits people under 18, contrary to the Children Act (Cap. 59) and the Prevention of Trafficking in Persons Act, 2009
- Your Contributions do not include offensive comments connected to race, national origin, tribe, gender, religion, or disability, contrary to the Equal Opportunities Commission Act, 2007 (Uganda)
7. Contribution Licence
By posting Contributions, you grant Selam Ride Technologies Limited an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide right and licence to host, use, reproduce, publish, distribute, translate, and create derivative works from your Contributions for any purpose. Subject to the Copyright and Neighbouring Rights Act (Cap. 215) of Uganda, you waive all moral rights in your Contributions. You retain full ownership of all of your Contributions and any associated intellectual property rights.
8. Liability
8.1 Licensor's responsibility in the case of violation of obligations and tort shall be limited to intent and gross negligence. Only in the case of a breach of essential contractual duties shall the Licensor also be liable for slight negligence, limited to foreseeable, contractually typical damages. This limitation does not apply to injuries to life, limb, or health.
8.2 To the extent permitted by applicable Ugandan law, Selam Ride Technologies Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Application, including loss of data, loss of revenue, or loss of profits.
9. Warranty
9.1 Licensor warrants that the Application is free of spyware, trojan horses, viruses, or any other malware at the time of Your download, and that the Application works as described in the user documentation.
9.2 No warranty is provided for the Application that has been unauthorisedly modified, handled inappropriately, combined with inappropriate hardware or software, or where there are other reasons outside of Selam Ride Technologies Limited's sphere of influence.
9.3 You are required to inspect the Application immediately after installing it and notify Selam Ride Technologies Limited about issues without delay by email at info.selamrideuganda@gmail.com. Defect reports must be submitted within ninety (90) days after discovery.
9.4 If we confirm that the Application is defective, Selam Ride Technologies Limited reserves the right to remedy the situation by resolving the defect or by means of substitute delivery.
10. Product Claims
Selam Ride Technologies Limited, and not Apple Inc. or Google LLC, is responsible for addressing any claims of the End-User or any third party relating to the licensed Application, including product liability claims, any claim that the licensed Application fails to conform to any applicable legal or regulatory requirement under Ugandan law, and claims arising under consumer protection, privacy, or similar legislation in Uganda.
11. Legal Compliance
You represent and warrant that You are at least eighteen (18) years of age, that You are a resident of or lawfully present in the Republic of Uganda or a jurisdiction where use of the Application is lawful, and that You will use the Application only for lawful purposes in accordance with applicable Ugandan laws and regulations, including the Traffic and Road Safety Act (Cap. 361), the Computer Misuse Act, 2011, the Electronic Transactions Act, 2011, and the Data Protection and Privacy Act, 2019.

13. Termination
This licence is valid until terminated by Selam Ride Technologies Limited or by You. Your rights under this licence will terminate automatically if You fail to adhere to any term of this licence. Upon termination, You shall immediately cease all use of the Application and destroy all copies in your possession. Selam Ride Technologies Limited reserves the right to suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable Ugandan law, or the rights of any third party.
14. Third-Party Terms and Beneficiary
In accordance with applicable instructions for minimum terms of developer End User Licence Agreements, Apple Inc. and Apple's subsidiaries shall be third-party beneficiaries of this EULA and, upon Your acceptance of the terms and conditions of this licence, Apple will have the right to enforce this EULA against You as a third-party beneficiary thereof.
15. Intellectual Property Rights
Selam Ride Technologies Limited, and not Apple Inc. or Google LLC, will be solely responsible for the investigation, defence, settlement, and discharge of any third-party intellectual property infringement claims relating to the licensed Application.
All intellectual property rights in and to the Application, including trademarks, logos, trade names, software, and content, are owned by or licensed to Selam Ride Technologies Limited and protected under the Copyright and Neighbouring Rights Act (Cap. 215), the Trademarks Act (Cap. 217), and other applicable intellectual property laws of Uganda. Nothing in this Agreement transfers any such rights to You.
16. Applicable Law and Dispute Resolution
This Agreement is governed by and shall be construed in accordance with the laws of the Republic of Uganda. Any dispute shall first be referred to mediation or alternative dispute resolution in good faith. If not resolved within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the competent courts of Kampala, Uganda.
17. Miscellaneous
17.1 Severability: If any term of this Agreement becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.
17.2 Entire Agreement: This Agreement, together with the Selam Ride Technologies Limited Privacy Policy and any additional terms incorporated by reference, constitutes the entire agreement between You and Selam Ride Technologies Limited with respect to the Application.
17.3 Amendments: Changes are only valid if communicated through the Application or by email in accordance with Section 12.
17.4 Waiver: Failure by Selam Ride Technologies Limited to enforce any provision of this Agreement shall not constitute a waiver of future enforcement.
17.5 Language: This Agreement is drafted in the English language. In the event of any conflict between this Agreement and any translation, the English language version shall prevail.
